Manufacturer

The manufacturer is a legal or natural person who is responsible for the design, manufacturing and placing on the market. As a manufacturer, you must ensure that your products conform to the regulations of the market they are placed in.

Importer

An importer places a product from a third country on the market. Importers have the obligation to check if the manufacturer has fulfilled the requirements of the market regulation they are importing in. Besides that, if the product is accompanied by the relevant documentation.

Distributor

A distributor acquires products for further distribution either from a manufacturer, from an importer, or from another distributor. You must be able to demonstrate to the national market surveillance authority upon request that you have checked to ensure the product supplier has followed all the relevant requirements.

You are not sure which requirements and regulations need to be fulfilled in the target market and want to place your product on this market safely and in compliance with the law. I will answer the questions that are currently on your mind.

The manufacturer is primarily responsible for product compliance. The responsibilities are then divided up within the company. A product compliance manager has the task of coordinating these responsibilities. Only when everyone contributes their part nothing stands in the way of a successful placing on the market.

Each economic area has its own requirements for product safety and the placing of products on the market.
These should already be recognised and implemented in the design phase of the product. If this is not done, cost-intensive changes may be necessary. This not only has a negative impact on the schedule but also on the budget.

This depends on how your quality management is organised. To name just a few actors, they all have an influence on product compliance: engineers, managers, purchasers, sales, etc.
The requirements for placing products on the market must be recognised and implemented by each responsible person.
That is why product compliance is a team effort. The challenge is to follow and manage the process precisely.

The short answer is ‘no’. First of all, different economic areas have different requirements for the product. To show this conformity, the product must be labelled with the Conformity Mark of the economic area.
In addition, different economic areas require different documentation and demand different tests. It is therefore important to enquire about the requirements before exporting to other countries.

That depends. Does your product go directly to an end customer or to a processing company? Some regulations relate directly to end products and end customers and some already include B2B.
With B2B marketing, it is important that the requirements that the product has to fulfil and which party will be responsible for the conformity assessment are contractually regulated in advance.
